Terms and Conditions

Terms of Service – ClickMe Smart Card

Effective Date: April 26, 2026

1. General Provisions

These Terms of Service (TOS) govern the use of all products and digital services offered by ClickMe Smart Card, including digital business cards, NFC/QR-based products, online profiles, and the webshop.
These Terms apply to all users who purchase products, register an account, or otherwise use the website.
By purchasing or using any product or service, the user agrees to be bound by these Terms in full.

All legal matters are governed by Hungarian law.

2. Legal Nature of Products and Services

ClickMe Smart Card products consist of two legally distinct components:

  1. Physical product (e.g., smart card, NFC/QR display, desktop plaque). Ownership of the physical product transfers to the purchaser upon purchase.

  2. Digital service (server, online profiles, databases, web functionality). The purchase grants the user a non-perpetual right to use the digital service.

The right to use the digital service is guaranteed for 24 months from the date of purchase. After this period, ClickMe Smart Card may modify, maintain, or discontinue the service with 30 days prior notice. Any modifications or discontinuation after the 24-month guaranteed period do not constitute defective performance.

During the 24-month guaranteed period, service downtime must not exceed 5% of the total time. Any downtime exceeding this limit may give rise to legal claims under applicable law.

3. User Responsibility and Public Availability

Users acknowledge and agree that any data, information, or profiles placed on ClickMe Smart Card products may be publicly accessible online.
Users assume full responsibility for the content they place on the products. ClickMe Smart Card does not assume any liability for the accuracy, legality, or consequences of this content.

4. Prohibited Content and Profile Termination

ClickMe Smart Card reserves the right to immediately and permanently terminate access to any digital service, profile, or account if illegal, unlawful, or prohibited content is uploaded or displayed.
Termination of access to the digital service does not affect ownership of the physical product, but the right to use the associated digital service is permanently revoked.
This decision is at the exclusive discretion of the provider and is non-appealable.

5. Warranty and Liability

Physical products (e.g., NFC cards, smart displays) are covered by a 1-year statutory warranty.

ClickMe Smart Card does not guarantee the continuous operation of free or promotional services and is not liable for any damages arising from such services, including service interruptions, modifications, or discontinuation beyond the 24-month guaranteed period.

Products, including Emergency ID products, are not official sources of information. Users assume all responsibility for the content they place on these products. ClickMe Smart Card disclaims any liability for consequences resulting from the use of such information.

Liability limitations:

  • The provider is liable for damages caused by intentional or grossly negligent acts.

  • In cases of minor negligence, liability is limited to foreseeable damages typical for the type of contract.

  • Liability for indirect, consequential, or incidental damages is excluded to the maximum extent permitted by law.

6. Subscriptions and Premium Services

Premium services operate under the conditions agreed at the time of purchase. Subscription fees may be monthly or annual and can be canceled at any time.

Users acknowledge that free services may display advertisements, the type, frequency, and content of which are at the sole discretion of ClickMe Smart Card.

7. Data Protection (GDPR)

ClickMe Smart Card processes personal data in compliance with the EU General Data Protection Regulation (GDPR 2016/679):

  • Personal data is collected only to the extent necessary to operate the service.

  • Users may request access to, correction, or deletion of their data at [email protected].

  • Data may be stored on third-party servers that comply with GDPR standards.

  • All data processors and service providers must comply with GDPR requirements.

8. Contact and Dispute Resolution

For questions, complaints, or technical issues, users may contact ClickMe Smart Card at [email protected].

Disputes should first be resolved amicably. If resolution is unsuccessful, Hungarian law applies, and the competent court is the court of the provider’s legal headquarters.
